Welcome to Experiences Nicaragua (hereinafter, "we", "us", "our", or "the Platform"). 1. Purpose and Nature of Services

Experiences Nicaragua operates as a digital e-commerce platform for itinerary design, consulting, and coordination of tourism experiences within Nicaraguan territory. We design and market both our own packages and activities, as well as those in partnership with independent local providers (hotels, transportation providers, local guides, adventure centers). By booking a service, Experiences Nicaragua undertakes to carry out all necessary business arrangements to ensure that the itinerary or tour is executed as agreed, acting with due professional diligence.

2. Booking Process and Payment Methods

  • Booking Confirmation: No service request will be considered confirmed until the Client has made the corresponding payment (either the required security deposit or 100% of the total value, depending on the type of activity) and receives a formal "Booking Confirmation" email from us.

  • Payment Methods: Online payments are securely processed through our authorized payment gateways (such as Tilopay / BAC Credomatic), accepting valid international credit and debit cards.

  • Rates: All prices are expressed in United States Dollars (USD) and are subject to change without prior notice before payment confirmation. Once the confirmation payment has been made, the price is frozen and guaranteed.

3. Cancellation Policy by the Client

We understand that travel plans can change. However, because we coordinate logistics, transportation, and block spots in advance, cancellations by the Client are subject to the following penalties based on how far in advance they are notified:

  • Cancellations more than 15 days prior to the tour start date: A 100% refund of the amount paid will be issued, deducting only non-refundable administrative fees or bank commissions generated by the payment gateway (approximately between 3% and 5% of the total value).

  • Cancellations between 14 and 7 days prior: A 50% refund of the total booking amount will be issued.

  • Cancellations less than 7 days prior or No Show: No refund will be granted. The Client will forfeit 100% of the booking value due to logistical and opportunity costs already incurred.

  • Note on modifications: If the Client wishes to reschedule their tour date instead of canceling, they must request it in writing at least 5 days in advance. This will be subject to availability and potential additional charges due to seasonal rate differences or local provider penalties

4. Cancellation, Modifications, and Refund Policy by the Company

  • Force Majeure and Weather Conditions: Nicaragua features microclimates and natural environments (volcanoes, lakes, rainforests) that can occasionally present unforeseen conditions. Experiences Nicaragua reserves the right to cancel or substantially modify an itinerary due to force majeure, natural disasters, adverse weather conditions that pose a safety risk, civil unrest, or government restrictions.

  • Minimum Number of Participants: Some of our shared tours require a minimum number of passengers to operate. If this minimum is not reached, the Client will be notified at least 48 hours in advance.

  • Options for Company Cancellations: In the event that Experiences Nicaragua is forced to cancel an activity due to the aforementioned reasons, the Client will be offered:

    • An alternative activity of equal or similar value.

    • Rescheduling the tour to a later valid date within the following 12 months.

    • A 100% refund of the money paid for that specific activity.

5. Limitation of Liability

  • Safety and Accepted Risk: The Client voluntarily acknowledges that adventure tourism activities, ecotourism, and travel in general entail certain intrinsic risks (including, but not limited to: hiking on uneven terrain, water activities, exposure to tropical weather). By booking, the Client declares to be in optimal physical and health conditions to perform the contracted activity and voluntarily assumes such risks."

  • Third-Party Providers: When we operate in partnership with third parties (hotels, private transportation, specific adventure activities), Experiences Nicaragua acts solely as a mediating agent. We are not responsible for negligence, material loss, accidents, personal injuries, delays, or non-compliance directly attributable to these independent providers, although we will actively cooperate to help the Client resolve any dispute."

  • Personal Belongings: The Traveler's luggage, money, photographic devices, and valuables are their sole responsibility throughout the entire journey. We are not responsible for theft, loss, or material damage occurring during the activities."

  • Travel Insurance: It is a highly recommended requirement (and for some extreme activities, mandatory) that the Client holds an international travel insurance policy with active medical and accident coverage during their stay in the country.

6. Traveler Behavior and Obligations

  • Follow Safety Instructions: Follow at all times the safety instructions provided by the guides and route coordinators.

  • Respect Local Regulations: Respect local laws, the regulations of protected areas and natural reserves in Nicaragua, as well as the customs of the visited communities (promoting sustainable tourism).

  • Punctuality: Arrive punctually at the designated meeting point. Delays exceeding 15 minutes without prior notice may be considered a No Show, resulting in the forfeiture of the tour and any right to a refund.

  • Right of Exclusion: The company reserves the right to remove any user from an activity, without the right to appeal or a refund, if their behavior endangers their own safety, that of the group, or the staff, or if they engage in offensive or illegal conduct.

7. Intellectual Property and Use of Visual Content

The trademarks, logos, texts, designs, and content published on the Website are the exclusive property of Experiences Nicaragua or are used under license. Their reproduction or commercial use without express authorization is strictly prohibited.

Use of Image: During the course of the tourism experiences, our staff or guides may take photographs or videos strictly for promotional and social media purposes for the brand @experiencesnicaragua. If you do not wish to appear in such material, please inform the guide at the beginning of the activity.

8. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Nicaragua. For any controversy, discrepancy, or claim arising from the interpretation or execution of this contract, the parties submit to the jurisdiction of the courts and tribunals of the city of León, Nicaragua, waiving any other jurisdiction that may correspond to them.

Refund Policy

At Experiences Nicaragua, our goal is to ensure that your adventure through our country is extraordinary. However, we understand that unforeseen circumstances may arise that force you to cancel or modify your travel plans. This Refund Policy establishes the conditions, timeframes, and procedures under which monetary refunds will be processed for the contracted tourism services.

By making a booking on our Website or official sales channels, you expressly accept the conditions detailed below.

1. General Refund Conditions

  • More than 15 days before the tour: 100% refund percentage (Only bank or payment gateway commissions are deducted, approximately 3% - 5%).

  • Between 14 and 7 days before the tour: 50% refund percentage of the total amount (Compensation for blocking spots, guides, and reserved logistics).

  • Less than 7 days or No Show: 0% refund (No refund. The client forfeits the total amount paid due to operational costs already incurred).

2. Refunds due to Company Cancellation (Force Majeure)

If Experiences Nicaragua is forced to cancel a tour or activity due to extreme weather conditions, safety alerts, natural disasters, government restrictions, or logistical failures of force majeure that jeopardize the safety of travelers, the procedure will be as follows:

  • An alternative activity of equal value or the rescheduling of the experience for a later agreed date (valid for 12 months) will be offered in the first instance.

  • If the Client cannot reschedule or does not accept the alternative, a 100% refund of the money paid for that specific activity will be approved, without any penalty.

3. Non-Refundable Expenses (Administrative Fees)

It is important for the Client to bear in mind that online payment gateways and banking institutions charge a transaction processing fee, which usually ranges between 3% and 5% of the total value.

In cases of approved 100% refunds, Experiences Nicaragua will return the full amount that entered our accounts, but the fee originally charged by the processing bank is non-refundable; therefore, the Client may see a slight minor difference in the final amount received.

4. Procedure to Request a Refund

  • Step 1: Send an email to reservas@experiencesnicaragua.com with the subject line "Refund Request – Booking Number or Client Name".

  • Step 2: Include in the message the details of the tour, the booked date, the digital proof of payment, and the reason for the cancellation.

  • Step 3: Our team will evaluate the request based on the timeframes stipulated in Section 1 and will formally respond within a maximum period of 48 to 72 business hours.

5. Timeframes and Methods for Refunds

  • Refund Method: The money will be refunded strictly to the same credit or debit card used to make the original purchase. For security reasons and anti-money laundering regulations, we do not issue refunds to third-party accounts or in cash if the payment was made digitally.

  • Processing Time: Experiences Nicaragua processes the refund order with the bank immediately. However, the time it takes for the money to be reflected in the Client's statement depends exclusively on their card's issuing bank. This process usually takes between 5 and 15 business days for international cards.
